GENERAL TERMS AND CONDITIONS OF SALE

1. Scope of Application

These General Terms and Conditions of Sale (hereinafter the “Conditions”) apply to all purchases of products (hereinafter the “Products” or the “Product”) concluded remotely through the website www.labottegadisguardi.com (hereinafter the “Site”).

These Conditions may be subject to modifications; the date of publication of the same on the Site shall be equivalent to the effective date.

2. Parties

The seller is Bottega di Sguardi, with registered office in Via G. Oberdan, 7R, 50132 Florence, VAT number 06965200483, REA FI – 673291 (hereinafter also the “Seller”).

These Conditions govern the sale of products to consumers and to professional buyers.

A consumer is understood as any natural person who acts for purposes unrelated to any business, commercial, craft, or professional activity carried out. A professional is understood as any natural or legal person acting in the exercise of their business, commercial, craft, or professional activity, or their intermediary.

Different provisions may apply to consumers and professionals, as expressly indicated.

3. Products and Availability

The Products and their prices are those listed on the Site. The Seller reserves the right to modify them at any time, without notice, it being understood that the price charged will be that indicated at the time of order.

The availability of the Products is constantly updated; however, since the Site may be visited simultaneously by multiple users, it is possible that the Product may be sold to another customer before the order is confirmed. In such cases, the Seller will promptly notify the customer by email or phone to agree on a solution (e.g., refund, waiting for restock, or replacement product).

4. Purchase Process

To place an order, the customer must follow the procedure provided on the Site, adding the desired Products to the cart, proceeding to checkout, and providing the required information. The order will be considered sent after clicking on the “Complete Order” button (or similar wording).

The customer will receive a confirmation email summarizing the essential elements of the sale (Product, price, shipping costs, payment method, etc.).

The contract is considered concluded when the customer receives the order confirmation from the Seller.

The Seller reserves the right not to process orders that are incomplete, incorrect, or inconsistent with commercial policy.

5. Prices and Payments

The prices of the Products are indicated in Euros and include VAT. Shipping costs are indicated separately and are borne by the customer unless otherwise specified.

Payments can be made by the methods indicated on the Site (e.g., credit card, PayPal, bank transfer). In case of payment by bank transfer, the order will be processed only after receiving confirmation of the crediting of the amount to the Seller’s bank account.

The payment data are managed directly by the relevant payment service providers; the Seller does not store payment data.

6. Delivery

Deliveries are made to the address provided by the customer during the order process. The delivery times are indicative and not binding. Any delays do not entitle the customer to compensation.

Upon delivery, the customer must check the integrity of the package and correspondence with the order. In case of damage or discrepancies, the customer must promptly notify the courier and the Seller.

7. Right of Withdrawal (only for Consumers)

The consumer has the right to withdraw from the contract, without giving any reason, within 14 days from the day of receipt of the Products.

To exercise the right of withdrawal, the consumer must notify the Seller by sending an explicit statement (e.g., letter sent by post, fax, or email) and return the Product in its original condition and packaging, without signs of use or damage.

Return costs are borne by the consumer unless otherwise agreed.

Upon receipt of the returned Products, the Seller will refund the amount paid, including the initial shipping costs (excluding additional costs resulting from the consumer’s choice of a delivery method other than the standard one), using the same payment method used for the purchase.

8. Legal Warranty and Non-Conformity (only for Consumers)

Consumers are entitled to the legal warranty of conformity provided by the Consumer Code. In case of defective or non-conforming Products, the consumer may request, free of charge, the repair or replacement of the Product, or, alternatively, a price reduction or termination of the contract.

The warranty lasts 2 years from delivery and must be claimed within 2 months from discovering the defect.

This warranty applies only if the Product has been used correctly, in accordance with its intended purpose and the instructions provided.

9. Professional Buyers

For professional buyers, the legal warranty is excluded unless otherwise agreed. The only applicable warranty is that provided by the manufacturer (if any).

The Seller is not responsible for indirect damages, loss of profit, or business interruption.

10. Applicable Law and Jurisdiction

These Conditions are governed by Italian law.

For consumers, any dispute will be subject to the jurisdiction of the consumer’s residence or domicile. For professionals, the exclusive competent court is that of Florence.
